Uncontested divorce in Spain (Albacete): steps, timescales and documents

When a couple decides to part ways and can reach an agreement, an uncontested (mutual consent) divorce is the fastest, cheapest and most respectful route. We handle many at our offices in Albacete and Villarrobledo; these are the steps worth knowing.
Requirements
- At least three months must have passed since the wedding (unless there is a risk to the spouse or children).
- Both spouses agree to divorce and on all the arrangements that will govern the new situation.
- A settlement agreement (convenio regulador) signed by both is submitted.
There is no need to give any grounds or explanations.
What the settlement agreement covers
It is the core document of the divorce and should be drafted carefully, because changing it later requires new proceedings:
- Custody of the children (sole or joint) and contact arrangements and holidays.
- Child support and how it is updated.
- Use of the family home and its contents.
- Sharing of extraordinary expenses (uncovered medical costs, glasses, activities).
- Spousal support, if one spouse is left at an economic disadvantage.
- Dissolution of the matrimonial property regime (community property), which can be done in the same agreement or later.
Notary or court?
- Before a notary: if there are no minor children who are not emancipated and no adult children with support measures. It is the fastest option: with the paperwork ready, it can be signed within days. A lawyer must attend.
- In court: if there are minor children or children with support measures. A joint petition is filed with the agreement; both spouses ratify it separately and the Public Prosecutor checks that it protects the children. The judge then issues the decree.
In the Albacete or Villarrobledo judicial districts, an uncontested court divorce is usually resolved within a few months, depending on the workload.
Usual documents
- Full marriage certificate and children’s birth certificates.
- Certificate of registration (empadronamiento).
- Signed settlement agreement.
- Financial documents: payslips, tax returns, deeds and loans, if community property is being divided.
For marriages celebrated abroad, the certificate may need to be legalised or apostilled and translated.
One lawyer or two
You can use the same lawyer for both, which reduces costs, as long as you genuinely agree. If there are sensitive issues, such as a mortgaged home or a family business, it may be better for each spouse to have their own adviser.
From contested to agreed
If you start without agreement, all is not lost: many contested divorces become uncontested after negotiation or mediation. And since 2025 an out-of-court settlement attempt is required before filing most family claims.
